Contractor Terms of Service

How You Accept These Terms

When you receive your GotaGuy onboarding SMS, you will be asked to reply AGREE to activate your account. By replying AGREE, you confirm that you have read, understood, and agree to be bound by these Contractor Terms of Service. Your reply is logged with a timestamp and constitutes a binding agreement.

1. Who We Are

GotaGuy is an SMS-based home repair marketplace operated by Kerzie AI Solutions, based in McKinney, TX. We connect homeowners with independent local contractors for repair and maintenance jobs. We are a coordination and payment platform — we are not a contractor and we do not perform any work ourselves.

2. Independent Contractor Status

You are an independent contractor, not an employee, agent, partner, or joint venturer of GotaGuy or Kerzie AI Solutions. You are solely responsible for:

Nothing in these Terms creates an employment relationship. GotaGuy does not withhold taxes, provide benefits, or control the manner in which you perform your work.

3. Licensing and Legal Compliance

You represent and warrant that you hold all licenses, certifications, registrations, and permits required by applicable federal, state, and local law to perform the work you accept through GotaGuy.

You are solely responsible for determining what licenses apply to your trade and location, and for maintaining those licenses in good standing. GotaGuy does not verify licensure and does not assume liability for unlicensed work. If you accept a job you are not licensed to perform, you may be removed from the network immediately.

You also agree to comply with all applicable building codes, permit requirements, and safety regulations for each job you accept.

4. Insurance

You are strongly encouraged to carry general liability insurance adequate to cover the work you perform. GotaGuy does not provide insurance coverage for contractors. Any property damage, personal injury, or other liability arising from your work is your sole responsibility.

5. How Dispatch Works

When a job matching your trade becomes available, GotaGuy will send you a job notification via SMS. Jobs are dispatched on a first-come, first-served basis. To participate in a job, use the following SMS commands:

You agree to only CLAIM jobs you intend to complete. Repeated no-shows or last-minute cancellations after claiming are grounds for removal from the network.

6. Pricing and Payment

GotaGuy provides homeowners with a price range estimate before dispatch. The final price is confirmed on site within that range. You agree to honor the quoted range communicated to the homeowner.

Payment is released by the homeowner via SMS confirmation after job completion. GotaGuy collects a service fee from the total job amount before disbursing your payment via Stripe. Your net payout after the service fee will be communicated at the time of job dispatch.

You must complete Stripe Express onboarding to receive payouts. GotaGuy is not responsible for delays caused by incomplete Stripe verification.

You agree that GotaGuy's service fee will be deducted automatically from each job payment before your payout is issued. The fee structure in effect at the time of each job applies.

7. Materials and Parts

Contractors are responsible for sourcing all materials required to complete the job unless otherwise agreed with the customer in advance. Material costs are handled directly between the contractor and customer and are not processed through GotaGuy. If additional materials or parts are discovered during the job that affect the total cost, the contractor must communicate this to the customer and agree on a revised price before continuing work. GotaGuy is not responsible for material costs, sourcing, or disputes related to materials.

You may manage your availability by texting BUSY or AVAILABLE to your GotaGuy number at any time. When set to BUSY you will not receive job notifications. When set to AVAILABLE you will receive notifications for jobs matching your trade in your area.

10. Removal from Network

GotaGuy reserves the right to remove any contractor from the network at any time, including but not limited to:

Removal is at GotaGuy's sole discretion. Any earned but unpaid amounts for completed jobs will still be disbursed.

11. SMS Consent

By joining the GotaGuy contractor network you consent to receive SMS messages from GotaGuy including job notifications, dispatch instructions, payment confirmations, and platform updates. Message frequency varies based on job volume in your area. Message and data rates may apply.

You may opt out at any time by replying STOP. Opting out will deactivate your contractor account. Reply HELP for assistance.

12. Limitation of Liability

GotaGuy is a marketplace platform and coordination service. We are not responsible for disputes between contractors and homeowners, property damage caused by contractor work, personal injury arising from job sites, or the quality of work performed.

To the fullest extent permitted by law, GotaGuy's liability to any contractor is limited to the service fees collected by GotaGuy on jobs performed by that contractor in the 30 days preceding the claim.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes arising from these Terms or your participation in the GotaGuy network shall be resolved in the courts of Collin County, Texas.

14. Changes to These Terms

GotaGuy may update these Terms from time to time. We will notify active contractors via SMS when material changes are made. Continued participation in the network after notice constitutes acceptance of the updated Terms.
